To extend your residence permit, you can be absent from Spain for no more than 182 days a year, and not in a row. But to obtain permanent residence after 5 years, you can be absent for no more than 10 months in all 5 years.
Therefore, we advise you not to be absent from Spain for more than 2 months in each year with a residence permit. With a residence permit, the days of absence from the territory of the Spanish state are counted, and with a permanent residence permit, the days of absence from the European Union are counted.
Modification of residence permit
After the first extension of residence without the right to work, you can apply for a modification of the residence permit and obtain the right to work.
It is also worth understanding that a residence permit without the right to work does not prohibit open your own business or buy an existing one. You can be the owner of a business and earn income.
Testimonials
We had to solve the issue of moving to Spain for a long period, and our tourist visa was about to expire. We didn’t bother and turned to the pros. And we didn’t regret it! They supported us and helped us at every stage of paperwork. They did everything promptly, without unnecessary questions. Now we have a student visa, and we are simply enjoying life in Spain: learning Spanish, enjoying the sun and the sea. Many thanks to Tatyana and Svetlana for their attention and professionalism!
When I decided to delve into the Digital Nomad residency issue, I turned to Tatyana. Before that, of course, I scanned the market and talked to a couple of people. Tatyana immediately caught my eye with her responsibility and accuracy (who knows how the Spanish market works, will understand that this is a rarity) and clear explanations of all the details. Even though my case was complicated, Tatyana prepared a list of documents in advance (and even suggested ways to save a little, since some of the documents could be avoided) that I would need. This helped speed up the process, and the next day after arriving in Spain I submitted the documents. Tatyana is always in touch, ready to answer all questions. As soon as we received approval for me and my wife, we were immediately signed up to submit fingerprints. The next thing on the list of things to do when I contact Tatyana again is residency for parents, a child, and replacement of rights.
I want to express my gratitude to Tatyana for her help with Nomand. The path was really difficult, I thought about giving up more than once at different stages (the last time I would have even preferred not to go for fingerprints ????) But Tatyana was always in touch, helped with documents and their registration here in Spain. And finally - hurray! I will receive my card in a month. Thank you all very much!
We are absolutely satisfied with the quality of services for obtaining a residence permit from Hispania! Anna gave us detailed advice on all the required documents, their preparation and legalization. She always answered our questions quickly and exhaustively, all problems were solved without delays. We received support at every stage: collection, legalization, apostille, appointment, help with finding a school and a lot of useful information on all aspects. Our case was far from the simplest, but thanks to the help of Hispania, the preparation of documents went smoothly, and no problems arose during consideration. The decision was even made earlier than expected. We are immensely grateful to Anna and Tatiana for prompt support, answers to all our questions and solving all problems. I highly recommend Hispania for cooperation.
Question and answer
Is it possible to obtain a D-type visa without the right to work at the consulate if I work remotely from Russia for a company from the European Union, rent an apartment, and have savings in the account of approximately 60 thousand euros? Despite the fact that the income is not passive, will it be sufficient for the family (spouse and child)?
According to the current requirements of the Spanish Consulate, it is not possible to work in Spain or in other countries. It is necessary to prove that there are sufficient funds in the account to live in Spain for the entire period of validity of the residence permit. In addition, it is necessary to provide evidence of passive income, since in this case remote income is not considered passive.
Can you clarify the required amount for one child aged 0 to 10 years when applying for a residence permit without the right to work (no lucrativa) for a family of three children? Will the required amount for children be reduced if there are five people in the family?
In 2023, the income indicator (IPREM) per person per year increased to €7,200. To apply for a residence permit without the right to work (no lucrativa), you must have €28,800 for the main applicant and €7,200 for each subsequent family member (a total of €57,600 for five applicants).
We are going to move to Spain with the whole family of five, because the children were invited to play in a football club. We need a type D visa without the right to work. Tell me, how much money do we need to have in the account? Is passive income required, or is it enough to have savings in the bank? We all have Russian and Egyptian citizenship. My husband has an account in an Egyptian bank, the funds are in Egyptian pounds. Can we provide a certificate from the bank?
To obtain a residence permit without the right to work, you must have at least 400% of the minimum subsistence level in Spain (IPREM) for each family member in your bank account. You must also provide evidence of passive income. Usually, a certificate from a Spanish bank is required, but in practice, the Spanish consulate in Moscow may accept a certificate from a Russian bank.
Can I get a D visa in Spain without the right to work or family reunification (like a spouse) while I am there on a tourist visa?
Currently, full registration of residence permits without the right to work or on the basis of family reunification in Spain is not provided. However, you can obtain a residence permit in Spain if you are a family member of an EU citizen or an investor.
